Terms of Use — AI Baby Growth Tracker

These Terms of Use ("Terms") are a legal agreement between you and Amol Pomane, trading as Mobify Studio ("we", "us", "our"), governing your use of the AI Baby Growth Tracker iOS app (the "App").

By downloading, installing or using the App, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the App.

1. What the App is — and what it is not

The App helps parents and caregivers record a child's growth measurements, feeding, sleep and nappy logs, milestones, vaccination records and related notes. It places measurements against published growth references from the World Health Organization (WHO) and the U.S. Centers for Disease Control and Prevention (CDC), and can generate plain-language summaries and reports.

The App is not a medical device. It is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition, and it has not been submitted to or cleared by any regulatory authority for any such purpose.

The App does not measure anything itself. Every measurement is a number you enter. It performs arithmetic on the values you provide against published reference tables.

1.3 What percentiles and summaries mean

A percentile or z-score describes where a single number you entered sits relative to a published reference population. It is not an assessment of your child's health. A single reading is one point on a curve.

The App deliberately does not tell you what to do about a measurement. Where it points you to a clinician, that is a signpost, not advice.

1.4 Accuracy of the references and your data

We take care to reproduce the WHO and CDC reference data faithfully and to cite our sources in the App. We do not warrant that any calculation, percentile, summary, report or reminder is accurate, complete or suitable for any decision about your child's care.

Anything the App shows you is only as good as what you entered. Incorrect units, dates, or a mistyped digit will produce confident-looking output that is wrong.

1.5 Reminders are not a clinical schedule

Vaccination and appointment reminders are a convenience. They are not a clinical immunisation schedule, they may not match your country's or your clinician's schedule, and we do not guarantee any notification will be delivered. Never rely on the App as your only reminder for a medical appointment or immunisation.

2. Who may use the App

• You must be at least 18 years old, or the age of legal majority where you live, and able to enter a binding contract.
• The App is for personal, non-commercial use. It is not for use by healthcare professionals to deliver care, and it is not a clinical record system.
• Records about a child may only be created by a parent, legal guardian, or someone with that person's authority. By entering information about a child you confirm you have that right, and that you have any consent needed from anyone else with parental responsibility.
• Children may not create their own accounts. The App is designed for an adult recording information about a child.

3. Your account

You can use core tracking features without an account. If you create one (by email, Apple Sign-In or Google Sign-In), you are responsible for keeping your credentials secure and for activity under your account.

Deleting your account. You can delete your account and its data from inside the App at More → Profile → Delete Account, and full instructions — including an email route if you cannot sign in — are at Account & Data Deletion — iOS app. Deletion is permanent. Export anything you want to keep first. Deleting your account does not cancel an App Store subscription — see section 5.6.

4. Your content, and our licence to it

The measurements, notes, photos and records you enter are yours. We claim no ownership of them.

You grant us only the limited licence needed to operate the App for you: to store, process, back up, sync and display your content, and to transmit it to the third-party processors described in section 7 and in our Privacy Policy.

You are responsible for keeping your own copies. Use the App's export features. We do not guarantee that data will not be lost, and we are not a backup service.

5. Purchases and subscriptions

The App is free to download and includes ongoing free features. Some features require a paid plan ("Premium").

5.1 What Premium currently unlocks

Premium unlocks:

• Tracking more than one child in a single account
• Vaccination tracking
• Doctor Mode
• Data export (including PDF reports)
• The Growth Guide / AI Coach, including AI-generated summaries and answers
• Longer chart history ranges (2 years and All time)
• Multi-child growth comparison across the full history

Free accounts include unlimited measurement logging for one child, growth charts with percentiles and z-scores against WHO and CDC references, milestone tracking, feeding, sleep and nappy logs, and chart history ranges up to 1 year.

We may change what each tier includes. If we materially reduce what a paid plan provides, section 14 applies.

5.2 Plans

The current price of each plan, in your local currency, is shown in the App before you confirm any purchase, and on the App Store product page. Prices vary by country and may change.

5.3 Free trial

Subscription plans currently include a 7-day free trial for new subscribers.

• Unless you cancel at least 24 hours before the trial ends, the subscription begins automatically and the plan price is charged.
• If you buy a subscription while a free trial is active, the unused portion of the trial is forfeited.
• Free trials are limited to one per Apple ID per subscription group, at Apple's discretion.

5.4 Auto-renewal — please read

• Subscriptions renew automatically. Your payment method is charged the then-current price at the start of each new period until you cancel.
• Renewal is charged within 24 hours before the end of the current period.
• Cancel at least 24 hours before the period ends to avoid being charged for the next one.
• Cancelling stops future charges. It does not end the period you have already paid for; Premium remains active until that period expires.

5.5 Payment is handled by Apple

All purchases are processed by Apple through your App Store account. We never see or handle your payment card details. Your purchase is also subject to Apple's Media Services Terms and Conditions.

5.6 How to manage or cancel

Manage or cancel at any time on your device:

Cancelling must be done through Apple. We cannot cancel an App Store subscription for you, and deleting the App or your account does not cancel it.

5.7 Refunds

Purchases are processed by Apple, so refunds are governed by Apple's policy and are at Apple's discretion. Request one at reportaproblem.apple.com. We generally cannot issue refunds directly. Nothing here limits any statutory refund or cancellation right you have under the consumer law of your country.

5.8 Restoring purchases

Entitlements are tied to the Apple ID that made the purchase. Use Restore Purchases in the App to recover them on a new device or after reinstalling. If you purchase while signed out of an App Store account, or purchase without a Mobify Studio account, we may be unable to associate the entitlement with a specific account of ours.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App, except to the extent that restriction is unenforceable where you live;
• Copy, resell, sublicense, rent or redistribute the App or any part of it;
• Circumvent purchase or entitlement checks, or attempt to obtain Premium without paying;
• Use the App to store or transmit unlawful content, or another person's health information without their authority;
• Interfere with the App's operation or attempt unauthorised access to our systems or another user's data;
• Use the App or its output to provide clinical care, or present its output as a clinical or diagnostic finding.

7. Third-party services

The App relies on third parties to work. Your use of the App is also subject to their terms, and you agree to comply with any that apply to you:

AI features send information about your child to Google for processing. What is sent, why, and how to decline is described in the App's own AI consent screen and in our Privacy Policy. AI features are optional and require your consent.

AI-generated text can be wrong, incomplete or misleading. Treat it as a prompt for a conversation with your clinician, never as a finding. Sections 1.1 and 1.2 apply to everything the AI produces.

8. Intellectual property

The App, its design, code, text, illustrations and trade marks are owned by Mobify Studio or its licensors and are protected by intellectual-property law. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. No other rights are granted.

The WHO and CDC growth references and the CDC milestone material are the work of those bodies and are used and cited in accordance with their terms. We claim no ownership of them.

We represent that we own or have licensed the rights needed to provide the App, and that the App does not knowingly infringe any third party's rights. We are solely responsible for investigating and resolving any claim that the App infringes a third party's intellectual-property rights — Apple is not.

9. Maintenance, support and availability

We — not Apple — are solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services for it.

We may change, suspend or discontinue any part of the App, and we are not obliged to provide updates. We do not guarantee uninterrupted availability. Some features require an internet connection and will not work offline.

10. Disclaimer of warranties

To the maximum extent permitted by law:

We do not warrant that the App will be error-free, that any calculation or summary is accurate, or that it will meet your requirements.

Apple warranty and refund mechanism. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits your non-excludable rights under the consumer law of your country.

11. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or anticipated savings, arising out of or relating to your use of the App.
• We are not liable for any decision made about a child's health, care, feeding, medication or development in reliance on the App. Those decisions belong with a qualified healthcare professional.
• Our total aggregate liability arising out of or relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or USD 50.

These limits do not apply to liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law. Nothing here affects your non-excludable statutory consumer rights.

Apple is not liable for any claim relating to the App, and Apple is not responsible for addressing any claim you or a third party may have relating to the App.

12. Product claims

We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of HealthKit or Firebase.

13. Legal compliance and export

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms when using the App.

14. Changes to these Terms

We may update these Terms. If a change materially affects your rights or what a paid plan provides, we will give reasonable notice — in the App, by email, or by updating the "Last updated" date above with a summary of what changed.

Changes are not retroactive. If you do not accept a change, stop using the App and cancel any subscription before the next renewal. Continuing to use the App after a change takes effect means you accept it.

15. Termination

You may stop using the App at any time and delete your account (section 3).

We may suspend or terminate your access if you materially breach these Terms — in particular section 6 — or where required by law. This licence terminates automatically if you fail to comply with these Terms; on termination you must stop using the App and delete it from your devices.

Where we terminate for reasons other than your breach, we will refund the unused portion of any prepaid period to the extent required by law or by Apple's policies.

Sections 1, 4, 8, 10, 11, 12, 16 and 17 survive termination.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Pune, Maharashtra, India have non-exclusive jurisdiction. Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, or of your right to bring proceedings there.

17. General

• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
• Severability. If a provision is unenforceable, the rest stays in force.
• No waiver. Not enforcing a provision is not a waiver of it.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the App.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
• Privacy. How we collect and use information is described in our Privacy Policy, which forms part of these Terms.
